I could be wrong about all this (I don't follow lkml) but I believe the deprecated bit is not sysfs itself, just a number of directories under the /sys tree.
I'm certainly aware of that one - I think that is the one tied up with migrating to kernel 2.6.13 and things breaking if you don't have the right version of udev which is why they put this kernel option in. I had a feeling there was more to it (I could be wrong). I'll keep my eyes peeled and search as I can.
