Did anybody else grit their teeth when they read that? Of course Linux is “copyrighted code” -- the copyright belongs to the developers who wrote that code for Linux, after all. They could have said “infringing code”. Or “code copied from proprietary Unix”. But still, there is this lingering assumption that the copyrights belonging to Free software somehow count for less than those for proprietary software.
