I think Linksys will release code quickly. The far bigger vendor which has got far more to lose on a case like this is VMWare - it seems almost certain that they are running a Linux kernel and have modified it, but claim they use modules in a way that doesn't break the GPL...
And VMWare have just brought Tungsten Graphics which would confirm even
