While the SFC is acting on behalf of a whole bunch of contributors of GPL’d code to the Linux kernel, according to <https://www.theregister.com/2021/10/20/vizio_gpl_lawsuit/>, this case is different from previous ones in that The SFC claimed that this is the first case that "focuses on the rights of individual consumers as third-party beneficiaries of the GPL." In the past, the SFC said, "the plaintiffs have always been copyright holders of the specific GPL code." So it looks like the SFC is going to argue in court that it is (mainly) the rights of buyers of the product (as granted by the GPL) that are being infringed, not so much those of the holders of the copyright in the code.
