non-GPL kernel mods are a break the GPL anyways.. one should not be using them ;)
There is a reasonable amount of debate about whether that actually is the case when code is done using EXPORT_SYMBOL which is what most module hooks are. There is a growing move to use EXPORT_SYMBOL_GPL which people absolutely cannot use in closed source drivers. Slowly things are being changed over and it is probably a matter of time before something is broken on purpose.....
