Do you suppose that SCO actually wanted to be driven to this situation all along? As in they saw the writing on the wall years ago and determined the fastest way to get some kind of legal protection to prolong the business was to enter this process? Maybe that's a bit cynical. They could have just been complete idiots.
You can look at it as a huge, prolonged pump-and-dump strategy on behalf of the directors, as shareholders... raise the stock price as much as possible with the threats of lawsuits, and then sell the stock, not caring what happens after that!
