Even if the licence waives patent rights, that doesn’t prevent lawsuits coming from some other party claiming patent rights. CC0 is supposed to be equivalent to public-domain, i.e. no copyright claimed at all. As far as I know (IANAL), that “public-domain” concept implies nothing about patent issues.
